1. About Us

The Djoula platform (hereinafter “Djoula” or “the Platform”) is operated by [TO BE COMPLETED: company name, legal form, RCCM number, headquarters address]. Customer service can be reached using the contact information provided at the bottom of each page of the website.

These General Terms and Conditions of Sale (“GTC”) apply to any order placed on the Platform by a buyer (“you”). By confirming an order, you acknowledge that you have read and accepted these terms. The applicable version is the one in effect on the date of the order; it is retained with your order.

2. An Online Marketplace: Who Sells What to You?

Djoula is an online marketplace. Most products are sold by independent sellers—whether businesses or individuals—based in Guinea or other countries. The seller’s name and country are indicated on each product page (“Sold by…,” “Shipped from…”).

  • The sales contract is entered into directly between you and the seller. The seller is responsible for the product, its description, shipping, and returns.
  • Djoula provides the Platform, processes online payments on behalf of sellers, handles customer service, and acts as a mediator in the event of a dispute (see Article 11).
  • When a product is sold directly by Djoula, this is indicated on the product page; in such cases, Djoula is the seller.

3. Your Account

An account is required to place an order. You agree to provide accurate information and to keep your password confidential. You are responsible for orders placed through your account. Djoula may suspend an account in the event of fraudulent use, abuse (such as repeated unjustified returns or complaints), or failure to comply with these Terms and Conditions.

4. Products and Information

Product specifications, photos, and descriptions are provided by the sellers, under their sole responsibility. Photos are not binding when presented as illustrations. Offers are valid while supplies last. If a product turns out to be unavailable after you place your order, the seller or Djoula will notify you, and you will receive a full refund of the amount paid for that product.

5. Prices and Currencies

  • Prices are displayed inclusive of all taxes when taxes apply in the seller’s country. They do not include shipping costs, which are displayed separately before the order is confirmed.
  • You can view prices in the currency of your choice; this conversion is for informational purposes only and is based on an exchange rate that is updated regularly. Online payment is made in Guinean francs (GNF); any conversion to your currency is performed by your bank or payment provider, subject to its own terms and conditions.
  • The price charged is the price displayed at the time the order is confirmed. In the event of an obvious pricing error (a ridiculously low price), the seller may cancel the order; you will then receive a full refund.

6. Ordering

To place an order, add products to your cart, select your shipping address and delivery method for each seller, accept these Terms and Conditions, and then pay (or choose cash on delivery when available). A confirmation email summarizes your order; you can view it in your account, along with the invoice.

An order containing products from multiple sellers may be shipped in separate packages, with each seller shipping their own items. The seller may refuse or cancel an order for a legitimate reason (product unavailable, undeliverable address, suspected fraud); in such cases, you will receive a full refund.

7. Payment

  • Online payment: via mobile money (Orange Money, MTN MoMo, etc.) or credit/debit card, through our secure payment provider. Djoula never stores your card information. The order is processed as soon as payment is confirmed by the payment provider.
  • Cash on Delivery: Offered only by certain sellers and for certain destinations. You pay the seller or their delivery person upon receipt. This option is not available for downloadable products.
  • Promo codes, gift cards, loyalty points, and referral credits must be used in accordance with the terms displayed when they are issued; they have no monetary value outside the Platform and are not redeemable for cash.

8. Delivery

  • Each seller offers its own delivery options (home delivery, in-store pickup, international shipping, etc.), along with their prices, estimated delivery times, and the countries served. The available options depend on the country of your shipping address.
  • Shipping fees are charged once per seller, regardless of the number of items purchased from that seller. An additional fee may apply to heavy or bulky items; this is indicated on the product page and in the shopping cart.
  • Delivery times are estimates and begin upon payment confirmation. In the event of a significant delay, contact the seller via the messaging system, then customer service.
  • International shipments: Any customs duties, import taxes, and customs clearance fees are your responsibility and may be charged upon delivery. You are responsible for complying with your country’s import regulations.
  • The seller may offer shipping insurance for certain shipments; this is optional and billed separately.
  • Check the condition of the package upon receipt. If the package is damaged, opened, or incomplete, report it as soon as possible (with supporting photos) via the messaging system or customer service.
  • Downloadable products: These are available in your account as soon as payment is confirmed; no shipping fees apply.

9. Returns and Refunds

You can request a return of a physical item within 30 days of delivery through your account, in accordance with our return policy. Only physical items can be returned: downloadable products, which are available immediately after payment, cannot be returned. For international shipments, you are responsible for return shipping costs, unless the product is defective or there was an error on the seller’s part.

10. Warranties

The seller warrants that the product conforms to its description and is free from defects that render it unfit for its intended use, in accordance with applicable law. If you receive a defective, damaged, non-compliant, or incorrect product, you may obtain a replacement or a refund, including return shipping costs, in accordance with the return policy. Any commercial warranties offered by a seller or manufacturer are listed on the product page.

11. Buyer Protection and Disputes

In the event of a problem (package not received, non-compliant product, refund not issued, etc.):

  • First, contact the seller via the Platform’s messaging system; the seller has a reasonable amount of time to respond.
  • If no resolution is reached, contact Djoula’s customer service. Djoula will review the evidence from both parties (messages, package tracking, photos) and propose a solution.
  • For an order paid for online, Djoula may withhold payment to the seller while the dispute is pending and, if your claim is valid, refund you from the amounts owed to that seller.

This mediation service is free of charge. It does not deprive you of your right to bring the matter before the competent courts (Article 15).

12. Reviews and Published Content

You may post reviews and questions about the products you have purchased. They must be honest, respectful, and free of personal contact information or promotional links. Djoula may moderate or remove any content that is illegal, offensive, or misleading, and does not accept paid reviews or reviews written by the seller.

13. Djoula’s Liability

Djoula is committed to using its best efforts to ensure access to the Platform and the security of payments, though it cannot guarantee uninterrupted service. The seller remains responsible for the products they sell. Djoula is not liable for damages resulting from force majeure, misuse of the product, or the actions of a third party (carrier, customs, etc.), without prejudice to the support provided for in Article 11.

14. Personal Data

Your data is processed in accordance with our privacy policy.

15. Governing Law and Disputes

These Terms and Conditions are governed by the laws of the Republic of Guinea, without prejudice to mandatory provisions protecting consumers in their country of residence. In the absence of an amicable settlement, any dispute shall be subject to the jurisdiction of the competent courts of Conakry, unless otherwise required by mandatory law.

16. Amendments to the Terms and Conditions

Djoula may amend these Terms and Conditions, in particular to reflect changes to the Platform or applicable regulations. The new terms apply to orders placed after they are posted online.
